Please read following Terms and Conditions carefully. You are required to read and understand them before using/ registering on Credit Card/ Merchant Portal or proceeding further on our Website. If you do not accept these terms please do not use this Website or the services provided by us as described on this website.
“CARD” – Credit Cards issued by BOBCARDS Ltd.
“USER” or “CARDHOLDER” or “YOU” – The person to whom or for whose use a CARD is issued by the ISSUER; the term shall likewise include the person to whom an add-on credit card is issued upon the application of the primary CARDHOLDER or any party acting on the CARDHOLDER's instructions.
“ISSUER” or “BOBCARDS” or “WE” or “US” – The Bobcards Ltd. whose registered office at 2nd Floor, “Baroda House”, Behind Dewan Shopping Center, S. V. Road, Jogeshwari West, Mumbai 400102.
"The Registrant" includes the person registered on the portal or any party acting on the Registrant's instructions.
"CONTRACT" means the contract constituted by the terms and conditions in our proposal (if submitted), these terms and conditions and your acceptance of them (as indicated by your ordering the provision of the Services).
"SERVICES" include any product or service sold (or provided at no cost) to you by us.
"SERVER" means the computer server equipment operated by us in connection with the provision of the Services.
“CREDIT LIMIT” – The maximum outstanding balance of charges which the CARDHOLDER and his/her supplementary CARDHOLDERS are allowed to maintain at any given time subject to security features and credit limit management features that the ISSUER may impose for the benefit of the CARDHOLDER.
“INSTALLMENT” –The facility which allows CARDHOLDERS to purchase selected goods and services from merchants using their CARD and to pay for the same, together with applicable interest and other fees, in equal monthly payments. In certain instances or promotions, ISSUER may allow the CARDHOLDER to convert cash advance transactions, existing balances on the CARD or balances on credit cards from other issuers into installment transactions, which shall be payable in equal monthly payments subject to the applicable interest and other fees.
“BOBCARDS” means the company wholly owned by Bank of Baroda.
a) BOBCards Ltd
b) Respective Banking entity controlled by Bank of Baroda.
c) a holding company , (ii) a subsidiary or (iii) a subsidiary of a holding company,
of The BOBCARDS Ltd ; as may be applicable.
In relation to any Clause(s) that are to or for the benefit of any member of the
BOBCARDS, "BOBCARDS" shall be deemed to include any Divested Business by bank of
Baroda from time to time unless expressly stated to the contrary in this Agreement;
For the purposes of the definition of the BOBCARDS the expressions “holding company”,
“subsidiary” and "subsidiary undertaking" have the meanings given to them in the
Indian Company Law (s).
"Merchant Establishment" means establishment wherever located which honours the Card and shall include among others, stores, shops, restaurants, hotels, airlines, cash advance points including ATMs and mail order advertisers (whether retailers, distributors or manufacturers).
"Merchant" means any person who owns or manages or operates the Merchant Establishment, its successors and permitted assigns.
"Minimum Amount Due" or "MAD" means the amount stated as such in the Statement.
"Total Amount Due" or "TAD" means is the amount stated as such in the Statement.
"Payment Due Date" means the date every month, on which the payment in respect of the charges incurred by usage of the Card by the Cardholder falls due as communicated through the Statement.
"Primary Cardholder" is the person in whose name the Card Account has been opened and to whom the Card has been issued.
"RBI" means the Reserve Bank of India.
"Statement" means monthly statement/s of account sent by BOBCARDS to a Cardholder setting out the financial liabilities on that date, of the Primary Cardholder and any Add on Cardholder to BOBCARDS in respect of the Card Account.
"ADD ON CARDHOLDER" means the family member of the Primary Cardholder who becomes a Cardholder by virtue of his relationship with the Primary Cardholder.
“TERMS AND CONDITIONS” or “AGREEMENT” – These Terms and Conditions for BOBCARDS’s Credit Card Products.
(a) a reference to an "amendment" includes a supplement, modification, novation,
replacement orre-enactment and "amended" is to be construed accordingly; an "authorisation"
or "approval" includes an authorisation, consent, clearance, approval, permission,
resolution, license, exemption, filing and registration; "law" includes any constitution,
statute, law, rule, regulation, ordinance, judgment, order, decree, authorisation,
or any published, directive, guideline, requirement or governmental restriction
having the force of law, or any determination by, or interpretation of any of the
foregoing by, any judicial authority, whether in effect as of the date of signing/submission
of the Application Form or thereafter and each as amended from time to time.
(b) the singular includes the plural (and vice versa);
(c) the headings in these Terms and Conditions are inserted for convenience of reference
only and are to be ignored in construing and interpreting the Terms and Conditions;
(d) reference to the words "include" or "including" shall be construed without limitation;
(e) reference to a gender shall include references to the female, male and neuter
genders;
(f) all approvals, permissions, consents or acceptance required from BOBCARDS for
any matter shall require the prior, written approval, permission, consent or acceptance
of BOBCARDS;
(g) references to VISA/MASTERCARD regulations pertain to the guidelines issued by
VISA/MASTERCARD to all the member banks of its network.
(h) in the event of any disagreement or dispute between BOBCARDS and the Cardholder
regarding the materiality of any matter including of any event, occurrence, circumstance,
change, fact, information, document, authorisation, proceeding, act, omission, claims,
breach, default or otherwise, the opinion of BOBCARDS as to the materiality of any
of the foregoing shall be final and binding on the Cardholder.
(i) the usage of the words " BOBCARDS Credit Card Agreement" on the Card or elsewhere,
means these Terms and Conditions.
The Card is the property of BOBCARDS. BOBCARDS reserves the right to (1) ascertain the credit worthiness of the Applicant by obtaining credit bureau report and such other reports as it may deem necessary and (2) decline to issue a Card to any Applicant at its sole discretion. The Card is not transferable and its usage is subject to the terms mentioned herein and any additional conditions stipulated by BOBCARDS from time to time. The Cardholder shall sign on the reverse of the Card immediately on receipt of the same. The BOBCARDS 24-Hour Customer Care Centre and/or Infinity is available to all Cardholders. The Cardholders availing of any services/facilities including but not limited to, enhancement of credit limit, enquiry on transactions, Total Amount Due, Statement details, Payment Due Date, etc. through BOBCARDS 24-Hour Customer Care Centre and/or Infinity, shall at all times continue to be bound by the terms and conditions stipulated by BOBCARDS with respect to the services / facilities.
i. Access to the Services shall be by following the Security Procedure prescribed by the BOBCARDS from time to time. The CARDHOLDERs would be allotted a unique User-ID and Password(s) by the BOBCARDS or any other suitable means of authentication as decided by Bobcards, in its sole discretion, in the first instance for accessing the Services. In addition Bobcards may, at its discretion, advice the CARDHOLDERs to adopt such other Security Procedure and means of authentication as the BOBCARDS may require.
ii. All Passwords chosen by the CARDHOLDER would require having such minimum characters or strings as Bobcards may from time to time specify. As a safety measure, the CARDHOLDER shall change the Password as frequently thereafter as possible. If the CARDHOLDER or, as the case may be, the User(s), forgets the Password, the CARDHOLDER may request for the issue of a new Password either by sending a written request to the BOBCARDS or in such other manner as the BOBCARDS may specify from time to time. The CARDHOLDER/User(s) agree(s) and acknowledges that the BOBCARDS shall in no way be held responsible or liable, if the CARDHOLDER/ User(s) incurs any loss as a result of the Password being disclosed/ shared by the CARDHOLDERs and/ or, as the case may be, the User(s) with unauthorized persons or in any other manner the security of the Password having being compromised.
iii. The CARDHOLDER and the Users authorized by the CARDHOLDER shall keep the Password including the password used to encrypt the private key absolutely confidential and well protected and shall not reveal the same to any unauthorized third person, including the employees and representatives of Bobcards. Bobcards does not take or accept responsibility for any loss suffered by the CARDHOLDER as a result of the CARDHOLDER or, as the case may be, any User disclosing the Password to any third person (including the employees and representatives of BOBCARDS and misuse of the same by such persons.
iv. The CARDHOLDER shall ensure that each User who avails of digital signatures for the purpose of using the Services shall generate the private key and the public key by following the appropriate and correct instructions prescribed by Bobcards and the CARDHOLDER shall be bound by the private key and the public key so downloaded/ generated by the members of its organization, including the Users. The CARDHOLDER takes full responsibility for the safe custody of the private key so generated and the CARDHOLDER would be responsible for and bound by any and all instructions given and/ or transactions carried out by the members of its organization by using the private key and the public key downloaded/generated by them. Any Instruction(s) received by Bobcards from the server / machine of the CARDHOLDER where the private key is downloaded by the CARDHOLDER shall be deemed to be an Instruction/ Instructions given by the CARDHOLDER and the CARDHOLDER hereby expressly agrees to be bound by the same.
v. The CARDHOLDER hereby agrees, acknowledges and confirms that the CARDHOLDER is availing of the facility to give Instructions in accordance with the terms contained herein entirely at its own risk and consequences. In the event of any Security Procedure being suggested/ prescribed by Bobcards, the CARDHOLDER shall use the same at its own risks and consequences and Bobcards shall be entitled to presume as genuine all Instructions given by using the Security Procedure.
vi. The CARDHOLDER acknowledges and agrees that Bobcards may act as a certifying authority or a registering authority or subordinate certifying authority for the purpose of issuing digital signatures and the CARDHOLDER shall not raise any objections as a consequence of Bobcards acting in one or more capacities, apart from being the relying party, who relies on the use of the digital signature availed of by the CARDHOLDER and/or its Users. The BOBCARDS in its sole discretion may specify/allow one or more external Certifying Authority for issuing digital certificates.
You are registering at your sole discretion and liability, if any. Registration for portal shall be availed by only authorized/ valid Cardholders and Merchant Establishments. Any misuse of the services so provided will be liable for the cost and consequences and subsequent prosecution thereof under Indian Penal Code/ Information Technology Act.
In the registration process you shall require to choose a unique User-Id subject to the availability of the same in the portal. You should therefore not assume that username/ User ID you desired will be available with us. Your successful registration will be notified by us on your registered E-mail Id.
BOBCARDS may reissue / re-generate the Credit Card PIN from time to time unless
earlier card is terminated or cancelled.
Request for reissuance / re-generation of the Credit Card PIN may be made by the
User on the Portal subject to the following conditions:
This service is chargeable and the same is availed by paying applicable charges if any and the User/ Cardholder is liable to pay the applicable charges. The details of the Applicable Charges may be referred from our Website. Reissued / re-generated / PIN will be dispatched to the registered mailing address (with Bobcards) of the Card holder / user and status of the request may be checked in Card / PIN Issuance / Dispatch Details option on the portal.
A Statement of Account (“SOA”) showing the transactions and balances in relation to the CARD will be furnished to the CARDHOLDER on a monthly basis. A printed/paper copy of the SOA may be sent by mail or courier to the CARDHOLDER’S billing address, or a PDF copy of the SOA may be accessed online by the CARDHOLDER via the ISSUER’s website upon enrollment by the CARDHOLDER to the ISSUER’s Credit Card e-Statement service in BOBCARDS’s Personal Internet Banking facility (“PIB”).
The CARDHOLDER may be sent a PDF copy of the SOA to his/her email address on a monthly basis if he registers to e-Statements through PIB or any other BOBCARDS channel. HOWEVER, the registered CARDHOLDER will no longer be sent printed/paper copies of the SOA upon such registration. The registered CARDHOLDER may revert to printed/paper SOA at any time in the future by setting SOA delivery preference to printed/paper SOA within PIB, by sending a written request to BOBCARDS, or by calling BOBCARDS Customer Care Nos. __________. In any event, BOBCARDS, at its sole discretion, may send printed/paper SOA whenever it deems necessary.
The CARDHOLDER agrees to examine and verify each entry appearing on a Statement of Account, reconcile it with the CARDHOLDER’s own records and immediately notify the ISSUER in writing of any errors, omissions, irregularities, including any fraudulent or unauthorized transactions or any other objections the CARDHOLDER has to that Statement of Account (collectively, “Account Irregularities”). If the CARDHOLDER fails to notify the ISSUER of such Account Irregularities within thirty (30) days from the date of the Statement of Account, the balance shown on the Statement of Account and all entries, including Account Irregularities, will be deemed correct, complete, authorized and binding upon the CARDHOLDER and the ISSUER will be released from all liability for any transaction occurring up to the date of the most recent Statement of Account except for transactions the CARDHOLDER gave notice of in accordance herewith.
The CARDHOLDER agrees to pay late payment or other charges for any unpaid amount due at a rate of ____per month or_______, whichever is higher, plus any applicable taxes and charges required by the government thereon. If the Payment Due Date falls on a Sunday or holiday, the payment shall be due the working day immediately preceding the Payment Due Date. However, notwithstanding the absence or lack of proof of service of the statement of account upon the CARDHOLDER, the latter is obligated to inquire with the ISSUER the amount, the CARDHOLDER is due to pay on or before the Payment Due Date.
The fixed monthly installment amount for purchases using the installment facility of the CARD shall be posted to the CARDHOLDER’s monthly statement of account as a regular transaction forming part of the total outstanding balance over the term or repayment period chosen by the CARDHOLDER. In case of pre-termination/cancellation of an existing installment transaction, the CARDHOLDER agrees to be charged a processing fee of __________or such other amount as may be set by the ISSUER from time to time.
All other terms and conditions stated in the monthly statement of account shall form an integral part of these terms & conditions
Bobcards will send the Card Holder a monthly statement showing the payments credited and the transactions debited to the Card Holder's Account since the last statement. The Bobcards will mail a statement of transactions in the card account every month on a predetermined date, to the mailing address / Email ID on record with the Bobcards. If the balance outstanding is less than Rs.200/ and there is no further transaction pending billing since the last statement, no statement will be issued.
We are also providing previous nine months statements on the portal for our card holders for their view / print / download. If card holder required old statement prior to this period (nine months) may use Preserved / Old Statement Request on the portal, by making the request card holder aggress that he is liable to pay the charges, if any. Further card holder agrees that the requested statement will be sent to his registered email id / mailing address with Bobcards, subject to the availability of the same with Bobcards. However Bobcards reserves the rights to issue / dispatch / email the statement or decline the required Old statement request at any point of time. Card Holder advised to preserve / download the statement provided by Bobcards.
Bobcards is providing the online Credit Card bill payment options to the card holders through various net banking service provider Banks including other available / various modes of payment. Card holder needs to pay the billed / minimum due amount to Bobcards well before due date Bill payment. Net banking payment service is sole discretion of the respective Bank; card holder has to use the other mode of payment in case of non-availability of the specific/ particular net banking payment mode on the portal. Card holder will not be entitled to the reversal / waiver of service charge / penalties, if any in case of non-availability of the specific/ particular net banking payment service on the portal.
The payment made through on line net Banking services available on the Portal will be credited to the Credit Card Account of the Cardholder within two- three working days.
BOBCARDS may replace the CARD from time to time unless earlier card is terminated or cancelled.
Request for replacement of Card may be made by the User on the Portal subject to the following conditions:

Reissued / re-generated / replacement / renewal Card will be dispatched to the registered mailing address (with Bobcards) of the Card holder / user and status of the request may be checked in Card / PIN Issuance / Dispatch Details option on the portal.
Card replacement/ renewal are at the sole discretion of Bobcards Ltd. After analyzing Credit worthiness of the Cardholder the request may be approved / rejected by Bobcards without informing / disclosing the reason of the same.
BOBCARDS may renew the CARD from time to time unless earlier card is terminated or cancelled.
Request for renewal of Card may be made by the User on the Portal subject to the following conditions:

Card replacement/ renewal are at the sole discretion of Bobcards Ltd. After analyzing Credit worthiness of the Cardholder the request may be approved / rejected by Bobcards without informing / disclosing the reason of the same.
The CARDHOLDER shall be liable for the amounts charged to the CARD, including cash advances, interest and all the non- refundable fees and other charges and taxes required by the government, whether made in the Philippines or abroad, and hereby agrees to accept and pay for such amounts without the necessity of proof of a signed charge slip. All charges, advances or amounts in currencies other than Philippine pesos shall be automatically converted at the time of posting to the billing currency (Philippine pesos) at VISA/MASTERCARD’s foreign exchange selling rate, and shall be charged additional fees equivalent to the following: ISSUER’s service fee equivalent to 2.50% of the converted sum, and reimbursement cost for the assessment fee charged by VISA/MASTERCARD to the ISSUER equivalent to 1% of the converted sum. The additional fees shall be imposed at the sole and absolute discretion of the ISSUER, and may be subject to change. The CARDHOLDER shall be informed prior to any such change. Such billing currency amount represents the amount due to the ISSUER for the ISSUER’s purchase and payment on the CARDHOLDER’s behalf of the foreign currency necessary to discharge the amount/s due to VISA/MASTERCARD and/or the acquiring bank and/or foreign merchant affiliate/s. For cash advances through any designated automated teller machines (ATM) which accept the CARD, the CARDHOLDER shall be assigned a Personal Identification Number (PIN) by the ISSUER. The CARDHOLDER shall change his/her ISSUER-assigned PIN through any BOBCARDS ATM. The CARDHOLDER shall at all times keep his/her PIN confidential and shall not, under any circumstance, disclose the same to any person or compromise its confidentiality. The CARDHOLDER agrees that all cash advances using the CARD shall be conclusively presumed to have been personally made or authorized by the CARDHOLDER.
The ISSUER may change the credit card number and/or expiry date when issuing a replacement card to the CARDHOLDER. The CARDHOLDER is solely responsible for communicating this change to any party with whom the CARDHOLDER may have payment arrangements. The ISSUER will not be responsible for any consequences arising from declined transactions, whether submitted under the old card number or otherwise.
The CARDHOLDER shall safely keep the CARD and not use the CARD after its expiry date or upon its cancellation or suspension nor permit anyone to use the CARD for any reason whatsoever.
The CARDHOLDER shall provide the ISSUER with copies of additional/updated documents that the ISSUER may reasonably require from time to time, including but not limited to copies of his/her latest Income Tax Returns (ITRs) duly stamped as received by the Bureau of Internal Revenue (BIR) and/or BIR Form 2316.
The CARDHOLDER shall pay the ISSUER a joining fee, subscription fee and an annual or membership fee as may be set by the ISSUER from time to time. The annual or membership fee and joining fee shall cover the administrative costs incurred by the ISSUER for the issuance and maintenance of the CARD. The ISSUER reserves the right to alter from time to time such benefits and the credit limit without any prior notice to or consent from the CARDHOLDER. Such benefits and credit limit shall further be subject to the other terms and conditions for the use of the CARD. All paid fees indicated herein are non-refundable even if the credit privileges are suspended or terminated, or if the CARD is surrendered by the CARDHOLDER before the expiry date.
I declare that the Add-on applicant is staying with me at the same residential address as provided in the primary application form and I understand that all Add-on communication including Additional card will be send to my residential address.
I understand that I can get an Additional Card for my Resident Indian Parent, brother, sister, spouse or child above 21 years of age. I agree that it will be my responsibility to provide identity or any other additional documents and/or information of the Additional Card member that may be required by BOBCARD Limited in future. I understand that I am liable to honour all charges incurred on the Additional Card.
I accept that the facility of an Additional Card will stand automatically terminated in case of termination of membership of the Primary Card Member.
I confirm that BFSL has shared the Most Important Terms and Conditions (MITC) for the card applied with me and available on its website www.bobfinancial.com. I have read, understood and accept the MITC.
I confirm that all communications pertaining to the Additional card will be sent to the preferred mailing address of the primary cardholder
I understand that issuance of Additional Card will be subject to eligibility and the BFSL’s internal processing/issuing criteria. I understand that BFSL reserves the right to decline the application.
The spend/Credit limit of the additional card will be shared with the primary card holder, any charges on the card will be borne by the primary card holder.
All the above terms and conditions will remain same for applying for 1 or 3 Add-on cards.
I hereby agree and understand that in the absence of me submitting OVD of my Current Address within a period of 3 months from the date of this application, BFSL shall be free to proceed with appropriate remedies, which may include but shall not be limited to cancellation of the Card issued to me.
We confirm that the information given is true and correct. We understand the Primary Card Member will be liable for all the charges incurred with the Primary Card and the Supplementary Card/Add-on card. We jointly and severally agree to be bound by the Rules and Regulations of use of the Credit Card, copy of which we have received and understood. In particular, we confirm the usage in strict accordance with the Exchange Control Regulations of the Reserve Bank of India. We understand that in the event of failure to do so, we are liable for action under the Foreign Exchange Regulation Act, 1973 and may be debarred from holding the Bank Of Baroda Credit Card, either at the instance of BFSL or the RBI. We authorise BFSL to verify information in this application and to receive, share or exchange information about us with other banks, agencies, companies, third parties, service providers, credit information companies etc. for marketing and administrative purpose or for prevention of frauds, etc.
The Aadhaar document/number, if any, is provided voluntarily to BFSL along with other KYC documents for the purpose of opening an account based relationship and BFSL is authorised to use the Aadhaar details for the purpose of authentication with UIDAI, if required. The Adhar card details voluntarily furnished by me is true, correct and complete.
The registered Users (On Portal) who do not want to avail these portal services shall deregister themselves from the Portal. If they wish to avail these services again, they may register themselves again on the Portal.
The card holders / users, those are availing the auto debit services or registered their Bank of Baroda account number with Bobcards may use this service request. By this option user / card holder may change their Auto Debit Payment mode to TAD (Total Amount Due) or MAD (Minimum Amount Due) or Specific Percentage (%) as per their need / wish. Any updating in auto debit will take effect only after 3-4 working days
Card Holder / User has to maintain the required balance in their respective Bank of Baroda account on the date of debit or last date of payment (in bill). Card holder / user shall be solely liable / responsible for any auto debit bounce / dishonor in Bank of Baroda auto debit service and shall be solely liable for any cost / charge / penalties and consequences thereof, if any.
The CARDHOLDER may opt to authorize in writing the ISSUER to charge the amount due on his/her card account against the CARDHOLDER’s deposit account or any funds with BOBCARDS by means of an automatic debit system.
The card holders / users, those are availing the auto debit services from their Bank of Baroda Account (debit directly by Bobcards) may use this service request. By this option user / card holder may change / cancel their Auto Debit Payment mode from TAD (Total Amount Due) or MAD (Minimum Amount Due) or Specific Percentage (%) as per their need / wish. Any updating in auto debit will take effect only after 3-4 working days.
After auto debit d-registration user / card holder shall be solely responsible for all the payment / charges payable to Bobcards any delay in payment of bill may attract the charges / penalties thereof, if any.
All eligible CARDS earn Bonus Points for all transactions made on the CARD excluding cash withdrawal, charges and fees. Cardholders of BOBCARDS Signature Visa, BOBCARDS Platinum Visa / Master, BOBCARDS Titanium Visa, BOBCARDS Assure, BOBCARDS Corporate Premium earn 1 / 1 ½ / 2 Bonus Points for every qualified Rs. 100 spent with our Cards. Bonus Points generated by card spending of add-on Cardholders shall automatically accrue to the Primary Cardholder’s account. Only those CARDHOLDERS whose card accounts are valid (i.e. CARD must not be delinquent, suspended, or cancelled) and all the card’s bonus points may be redeemed in cash where total accumulated bonus points is more than 500. Such use of Bonus Points is subject to specific terms and conditions for each type of CARD and each bonus point having value of Rs. 0.25. BOBCARDS reserves the right to restrict or limit the number of Bonus Points earned on each transaction in connection with special programs, facilities and promotional activities.
The Add-on Cardholders cannot redeem Bonus Points for Rewards cash or convert to gift.
For CARDHOLDERS of BOBCARDS, Bonus Points are valid up to respective financial year only. at the end of the relevant financial year, from cardholder’s transaction Date (bonus points earned). Card Holders need to send the bonus points redemption request by 31st May of next financial of the transaction / bonus point accumulated FY.
Example: Mr. X has earned 801 bonus points in Financial year (F.Y.) 2013-2014 (1st April 2013 to 31 March 2014). Card holder has to send the bonus points redemption request to Bobcards by 31st May 2014 other wise all the earned bonus points shall be expired and card holder will not be able to get the bonus points benefits for the bonus points earned between 1st April 2013 to 31 March 2014.
At present this card Blocking service is off line Card Blocking service, any / all card blocking request shall be executed after 2-3 working days.

Important Points:
1. Only unbilled transactions can be converted into EMI 2. The transaction will reflect in the portal within 2 days from the date of transaction. 3. The transactions amount should be at least Rs. 2500 or more for converting into EMI 4. Transactions on GOLD, JEWELLERY, FUEL & CASH won't be converted into EMI. 5. EMI request will be considered only for active and regular cards. 6. A processing fee, currently 2% of the transaction amount (subject to a minimum of Rs. 100) will be charged. 7. Pre-closure fee of 3% or a minimum of Rs.100/- shall be levied on the principal outstanding amount if the card /EMI facility is closed before the expiry of the EMI tenure.

Availing Instant EMI is very simple. Just ask the merchant for EMI options available on Bank of Baroda Credit Cards. The merchant may offer tenure options from 3 to 24 months. The rates of interest will range from 13% to 15% per annum, depending on the tenure. A processing fee may or may not be applicable.
After checking the available options and terms, just choose the tenure, and ask the cashier to charge your Bank of Baroda Credit Card for the same. However Card Holder / user may check their Card / PIN, current dispatch / delivery status on the respective courier website with the help of airway bill / reference number available on the portal. Bobcards will not be responsible in any manner for wrong / error in delivery status available on courier websites. Bobcards is updating the delivery status from courier website, hence will not be responsible for any wrong / error delivery report / status.
Card Holder / merchant establishments / users of Bobcards services / portal may user this services, with the help of the option users (of portal) may register their complaints / requests with Bobcards (other than above request).
Card Holder / merchant establishments / users of Bobcards services / portal, those have registered their Request / Complaints through Other Request / Complaints or specific request may check their request / complaints status and reply from this option / menu of the portal. Bobcards will update the same within 2-3 working days.
These services offered by Bobcards are only for analyzing your summarized spending pattern.
Upon acceptance or approval of the CARDHOLDER’S application, a CREDIT LIMIT expressed shall be assigned to the CARDHOLDER which represents the maximum outstanding balance, including any installment transaction/s made using the CARD, that the CARDHOLDER and his/her ADD ON Cardholder(s) are allowed at any given time subject to security features and credit limit management features that the ISSUER may impose for the benefit of the CARDHOLDER. The ISSUER reserves the right to decline or approve any transaction and/or suspend the credit card privileges of the CARDHOLDER and his/her ADD ON CARDS (without the ISSUER being necessarily obligated to do so) without prior notice if the CREDIT LIMIT will be or has been exceeded. The ISSUER may demand immediate payment of the amount in excess of the CREDIT LIMIT or of all amounts outstanding. The CARDHOLDER agrees to track his/her balance and is solely responsible for ensuring that it does not exceed the approved CREDIT LIMIT. In case the CARDHOLDER exceeds his/her approved CREDIT LIMIT on billing date, the CARDHOLDER shall pay the ISSUER an overlimit fee of __________for such billing period, or such other amount as may be set by the ISSUER from time to time.
The ISSUER may limit cash advances on the CARD to an amount determined at the ISSUER’s sole discretion, without notice to the CARDHOLDER. The CARDHOLDER shall pay the ISSUER a cash advance service fee of 3% of the amount drawn or PHP500.00, whichever is higher, or such other amount as may be set by the ISSUER from time to time. In addition to the cash advance service fee, the CARDHOLDER’s cash advance transactions shall also incur finance charges at the prevailing monthly interest rate applied to the cash advance amount from the transaction date until the amount is fully paid. The CARDHOLDER shall also pay the ISSUER all other fees incurred including without limitation annual mileage programme fee and transaction retrieval fee, at the rates set by the ISSUER and as may be amended from time to time.
In case the CARDHOLDER is issued two or more cards, the CARDHOLDER understands and agrees to abide by the condition that the ISSUER may, at the ISSUER’s sole discretion, give the CARDHOLDER a separate credit limit for each of the CARD issued to the CARDHOLDER or a consolidated credit limit for all CARDS, expressed in __________subject to security features and credit limit management features that the ISSUER may impose for the benefit of the CARDHOLDER. In case of default (in the) or non-payment of the CARDHOLDER’s obligation on one or more CARDS or at the ISSUER’s exclusive option, the ISSUER may at its sole discretion demand immediate payment in full of all outstanding balances on all of the CARDS and, in addition, revoke the CARDHOLDER’s right to use all or any of such CARDS.
The Cardholder can use the Card to access emergency cash from teller counters at Bank of Baroda branches/Automated Teller Machines (ATMs) of select Bank of Baroda locations or correspondent banks/other locations as decided periodically by BOBCARDS and as specified by BOBCARDS to Cardholder from time to time. The total amount that can be withdrawn under this facility at any point in time should not exceed the available Cash Limit as specified by BOBCARDS for each Cardholder. The Cardholder shall be required to retain the record of the transaction, generated by the ATM, with him. A transaction fee would be levied on all charges and would be billed to the Cardholder in the Statement communicated thereafter. In addition, all cash withdrawals will also attract a service charge calculated on an average daily outstanding balance method from the date of such withdrawal till the payment is received by BOBCARDS. This service charge will be debited to the Card Account. The transaction fees and service charges as mentioned above are non-refundable. The Cash Limit on selective Card , as may be specified by BOBCARDS, for the first one hundred eighty (180) days from the date of issuance of the Card shall be NIL. After the expiry of the first 180 days period, the Cash Limit shall be made available to the Cardholder by BOBCARDS at
The CARDHOLDER shall be entitled to cancel or modify any Instructions in the manner required by the BOBCARDS at any time before the BOBCARDS has made any payment pursuant to any such Instructions or has taken any action pursuant to an Instruction which cannot be reversed. The BOBCARDS will make reasonable efforts to cancel or, as the case may be, modify any Instruction as requested by the CARDHOLDER. However, the BOBCARDS shall not be held liable if it is unable to stop or prevent the implementation of the relevant Instruction(s).
The CARDHOLDER irrevocably and unconditionally authorises the BOBCARDS to access all its Account(s) for effecting Billing or other transactions performed by the CARDHOLDER through the Portal/ Website Services by giving Instructions.
Notwithstanding anything contained elsewhere in these Terms and Conditions, BOBCARDS shall have the sole right to amend or supplement any of these Terms and Conditions at any time if such amendment is required for the purpose of upgrading the existing Services or providing new services to the CARDHOLDERs. Such amended terms and conditions stipulated by BOBCARDS will thereupon apply to and be binding on the user. BOBCARDS shall endeavor to inform the CARDHOLDER of such changes.
The CARDHOLDER shall install at its own costs, such hardware and/or software including such encryption and security procedures as may be required by BOBCARDS from time to time to enable the CARDHOLDER to access the Services. A security procedure once established by mutual agreement in writing shall remain valid until it is changed by mutual agreement.
The CARDHOLDER acknowledges that the software and hardware underlying the Services as well as other Internet related software which are required for accessing and availing of the Services are the legal property of the respective vendors. The permission given by BOBCARDS to access the Services will not convey any proprietary or ownership rights in the said software or hardware. The CARDHOLDER shall not attempt to modify, translate, disassemble, decompile or reverse engineer the software / hardware underlying the Services or create any derivative product based on the software / hardware.
BOBCARDS shall adopt security measures as available in the industry from time to time. However the CARDHOLDER acknowledges that the technology used including the Internet is susceptible to a number of frauds, misuse, hacking, virus, malicious, destructive or corrupting code, programme or macro which could affect Services. This could result in delays in the processing of instructions or failure in the processing of instructions and any other such failures and BOBCARDS shall not be responsible for the same.
The CARDHOLDER shall take all necessary precautions to prevent unauthorized and illegal use of Portal/ Website and unauthorized access to the Accounts provided by BOBCARDS to the CARDHOLDER through Portal/ Website.
The CARDHOLDER is responsible for the correctness and accuracy of information supplied to BOBCARDS and shall ensure that there are no mistakes and errors in the information and Instructions given by the CARDHOLDER to BOBCARDS while using any facility of Portal/ Website or through any other means such as electronic mail or written communication. The CARDHOLDER acknowledges and agrees that in the event of any inaccuracy in any information and/ or Instruction, there could be consequent erroneous transfers. BOBCARDS accepts no liability for such or other consequences arising out of erroneous information and/ or Information supplied by the CARDHOLDER. If the CARDHOLDER notices an error in the information supplied to the BOBCARDS either in the Application Form or any other communication, it shall immediately advise the BOBCARDS which will endeavour to correct the error wherever possible on a "reasonable efforts" basis. In the event of CARDHOLDER's account receiving an incorrect credit by reason of a mistake committed by any other person, BOBCARDS shall be entitled to reverse the incorrect credit at any time whatsoever. The CARDHOLDER shall be liable and continue to remain liable to BOBCARDS for any unfair or unjust gain obtained as a result of the same.
Any and all changes in the information contained in the Application Form shall be communicated by the CARDHOLDER to BOBCARDS in the manner stipulated by BOBCARDS along with accompanying corporate resolutions. In the event a CARDHOLDER is desirous of changing the list of Users, the CARDHOLDER shall be entitled to do so by giving a letter to this effect to the BOBCARDS at the address specified by the BOBCARDS from time to time, along with accompanying corporate resolutions. Any such change notified by the CARDHOLDER to the BOBCARDS shall be effective only after 7 working days from the date of receipt of such letter by the BOBCARDS and till such time the BOBCARDS shall continue to accept and carry out Instructions received from any of the representatives of the CARDHOLDER whose names are mentioned in the list of Users then available with the BOBCARDS.
In the event of BOBCARDS making any changes, enhancements, and/or modifications to the Services and/ or RBI modifying any of the Schemes (where the CARDHOLDER has availed of the facility of funds transfer facility by giving Payment Instructions through any of the Schemes, the CARDHOLDER shall suitably modify/upgrade, at its own costs, its systems to comply with the BOBCARDS’s ENet System and various Services provided by BOBCARDS through ENet System and further agrees to execute such additional agreements, writings, documents as may be required from time to time as may be required in this regard. The CARDHOLDER hereby agrees that BOBCARDS shall not be liable for the failure of the CARDHOLDER to so modify/upgrade its systems to comply with the ENet System or for any losses, claims, damages, expenses and/ or liabilities arising out of such failure of the CARDHOLDER.
BOBCARDS may from time to time upgrade, modify, alter or perform maintenance services on BOBCARDS's ENet System (hereinafter collectively referred to as "Maintenance Services"). BOBCARDS shall endeavour to give prior notice of the maintenance services by providing such information on its Website or otherwise.
BOBCARDS shall not be under any obligation to support the software, hardware, operating or other systems of the CARDHOLDER and further shall not be liable for any losses, damages and/or expenses incurred by the CARDHOLDER in respect of any loss of access and/or use or interruption in the use of the ENet System or Services due to the Maintenance Services being performed on the same.
The CARDHOLDER hereby authorises the use of confidential information of the CARDHOLDER by BOBCARDS and the transfer by BOBCARDS of any information relating to the CARDHOLDER to and between the branches, subsidiaries, representative offices, affiliates, representatives, auditors and agents of BOBCARDS and third parties selected by any of them, wherever situated, for confidential use in connection with the provision of the Services to the CARDHOLDER, and further acknowledges that any such branch, subsidiary, representative office, affiliate, agent or third party shall be entitled to transfer any such information as required by any law, court, regulatory or legal process.
Except as warranted herein and in the Terms and Conditions, BOBCARDS makes no other express or implied warranty with respect to the Services provided hereunder, and hereby expressly disclaims all warranties of any kind, whether express or implied or statutory, including, but not limited to the implied warranties of uninterrupted, error-free, timely or secure performance of the ENet System/ Services, title, satisfactory quality, merchantability, fitness for a particular purpose, data accuracy and completeness, and any warranties relating to non-infringement in Portal/ Website services or any transmission of information from BOBCARDS to the CARDHOLDER being virus free.
BOBCARDS does not warrant that access to Portal/ Website shall be uninterrupted, timely, secure, or error free nor does it make any warranty as to the results that may be obtained from BOBCARDS’s Website or use, accuracy or reliability of Portal/ Website services.
In consideration of BOBCARDS providing Services to the CARDHOLDER in accordance with the terms and conditions contained herein, the CARDHOLDER shall, at its own expense, indemnify and hold BOBCARDS, its directors and employees, representatives, agents and/or the affiliates, as the case may be, indemnified against all losses and expenses on full indemnity basis which BOBCARDS may incur, sustain, suffer or is likely to suffer in connection with BOBCARDS’s or its affiliates' execution of the CARDHOLDER’s Instructions and against any and all actions, claims, liabilities (including statutory liability), penalties, demands, proceedings, losses, awards, damages, costs (including without limitation, legal costs of BOBCARDS on a solicitor and own client basis), charges, losses and/ or expenses as a consequence or by reason of providing the Services for any action taken or omitted to be taken by BOBCARDS and /or its affiliates, its officers, employees or agents, on the Instructions of the CARDHOLDER.
Further, the CARDHOLDER agrees, at its own expense, to indemnify, defend and hold harmless BOBCARDS, its directors and employees, representatives, agents, and its Affiliates against and all actions, claims, liabilities (including statutory liability), penalties, demands, proceedings, losses, awards, damages, costs (including without limitation, legal costs of BOBCARDS on a solicitor and own client basis), charges, losses and/ or expenses on a full indemnity basis which BOBCARDS, its directors and employees, representatives, agents, and affiliates may incur, sustain, suffer or is/are likely to incur, sustain, suffer to the extent that such claim, suit, action of other proceeding brought against BOBCARDS, its directors and employees, representatives, agents, and affiliates is based on or arises in connection with the Services with reference to:
In the event of BOBCARDS being entitled to be indemnified pursuant to the provisions of these Terms and Conditions, BOBCARDS shall be entitled to accordingly and to such extent debit the CARDHOLDER's Account or any other account that the CARDHOLDER may have with BOBCARDS, either singly or jointly with one or more person(s).
BOBCARDS and the CARDHOLDER agree that if the CARDHOLDER opens further Accounts and subscribes to any of the Services with respect to such new Accounts opened by the CARDHOLDER, and BOBCARDS, at the request of the CARDHOLDER, extends the Internet Banking facility to such Accounts and the CARDHOLDER opts for use thereof, then the Terms shall automatically apply to such further use of the Internet Banking by the CARDHOLDER.
BOBCARDS and the CARDHOLDER agree that if BOBCARDS provides further services to its CARDHOLDERs as a part of the Services and the CARDHOLDER subscribes to any such new Services offered by BOBCARDS, and BOBCARDS, at the request of the CARDHOLDER, extends the Internet Banking facility to such new Services, then the Terms shall automatically apply to such further use of the Internet Banking by the CARDHOLDER.
The BOBCARDS shall issue to the CARDHOLDER duly authenticated record of a transaction after completion of such transaction and a statement of Accounts through online/ offline mode for verification at the CARDHOLDER’s end. The CARDHOLDER shall with a period of 7 (seven) days from date of transaction report to the BOBCARDS any discrepancy in the execution of an Instruction. The CARDHOLDER agrees that it shall not be entitled to dispute the correctness of the execution of an Instruction or the amount debited to its Account if it fails to report the discrepancy with the aforesaid period.
All the records of BOBCARDS generated by the transactions arising out of the Instructions, including the time the transaction recorded shall be conclusive proof of the genuineness and accuracy of the Instructions received by BOBCARDS and the consequent transaction.
The CARDHOLDER agrees not to object to the admission of BOBCARDS’s records as evidence in any legal proceedings because such records are not originals, are not in writing or are documents produced by a computer.
BOBCARDS is permitted to utilize all information received by it from the CARDHOLDER as evidence against the CARDHOLDER before any competent Court of Law or Judicial or Quasi-Judicial Authority or Tribunal or any other statutory or government authority.
The CARDHOLDER understands and acknowledges that Internet is not necessarily a secure means of transmission. The CARDHOLDER acknowledges and accepts that such transmission methods involve the risk of possible unauthorized alteration of data, unauthorized usage therefore for whatever purposes and/ or virus attacks and are susceptible to a number of frauds, misuse, hacking, virus, malicious, destructive or corrupting code, programme or macro which could affect Services. This could result in delays in the processing of instructions or failure in the processing of instructions and any other such failures and BOBCARDS shall not be responsible for the same. The CARDHOLDER agrees to exempt BOBCARDS from any and all responsibility/ liability of such misuse or virus attacks/ transmission to the CARDHOLDER’s system and not to hold BOBCARDS responsible/ liable for any such misuse and/ or virus attacks/ transmission to the CARDHOLDER’s system and further agrees to hold BOBCARDS free and harmless from all losses, costs, damages, expenses that maybe incurred by the CARDHOLDER due to any errors, delays or problems in transmission or unauthorized/ illegal interception, alteration, manipulation of electronic data, virus attacks/ transmission to the CARDHOLDER’s system or otherwise caused by using Internet as a means of transmission of Instructions.
Under no circumstances shall BOBCARDS be liable for any damages whatsoever whether such damages are direct, indirect, incidental consequential and irrespective of whether any claim is based on loss of profit or revenue or anticipated savings, interruption of business, any loss of any goodwill, character or nature whatsoever and whether sustained by the CARDHOLDER or by any other person and which may arise in respect of the Services and/or these Terms and Conditions, including without limitation any loss of data, interruption or stoppage to the CARDHOLDER's access to and/or use of the Portal/ Website Services, or arising out of the performance of the Services or otherwise. Illegal or improper use of the Portal/ Website Services shall render the CARDHOLDER liable for payment of financial charges as decided by BOBCARDS or will result in suspension/termination of the operations through the Portal/ Website Services.
BOBCARDS reserves the right to discontinue all or any of the Services at any point of time, but BOBCARDS shall endeavor to provide a prior notice to the CARDHOLDER in this regard save and except in circumstances where BOBCARDS has discontinued all or any of the Services as a consequence of the CARDHOLDER committing any breach of the Terms and Conditions. BOBCARDS shall not be liable for any damages, claims of any nature whatsoever by reason of such termination or discontinuation of the Services, including the termination of agreement, if any.
Closure of Accounts of the CARDHOLDER will terminate the Portal/ Website Services.
Both the Parties are entitled to cancel the Services provided herein by giving a 15 days’ prior notice to the other party in this regard.
BOBCARDS may withdraw or terminate the Portal/ Website Services anytime either entirely or with reference to a specific service or user; or in case of breach of Terms by the user or concerns of security without a prior notice; or if it learns of the death, bankruptcy or lack of legal capacity of the user.
In case of termination of the Services, the CARDHOLDER shall promptly and its own cost returns all software, hardware and other devices provided by BOBCARDS.
All notice and communications under these Terms and Conditions relating to operating instructions, setup and modifications thereof given by the CARDHOLDER shall be in the manner prescribed by these Terms and Conditions or acceptable to BOBCARDS from time to time.
All other notices, communications and writings pursuant to these Terms and Conditions may be delivered by hand, by mail , by overnight courier service to (i) if by the CARDHOLDER to BOBCARDS may be delivered by hand, by mail, by overnight courier service to BOBCARDS, 2nd floor, Corporate Office, _____________________or such other address as may be notified by the BOBCARDS from time to time (ii) if sent by the BOBCARDS to the CARDHOLDER all notices shall be deemed to be given by hand delivery or by sending them by post to the last address given by the CARDHOLDER or as mentioned in the Application Form.
BOBCARDS may publish notices on its Website. Such notices shall have the same effect as notice sent individually to each CARDHOLDER.
BOBCARDS shall not be liable for any failure to perform any of its obligations under these Terms and Conditions if the performance is prevented, hindered or delayed by a Force Majeure Event and in such case its obligations shall be suspended for so long as the Force Majeure Event continues (provided that this shall not prevent the accrual of interest on a principal amount which would have been payable but for this provision). Each party shall promptly inform the other of the existence of a Force Majeure Event and shall consult together to find a mutually acceptable solution. "Force Majeure Event" means any event due to any cause beyond the control of the BOBCARDS, including without limitation, network failure, faults in computer systems, storage devices natural calamities, legal restraints or any other reason.
The CARDHOLDER hereby agrees to bear the standard charges including, without limitation, relating to transactions, instructions, setup & security, stop payment, and cancellation of Instructions) as may be stipulated by the BOBCARDS or rates/charges mutually agreed from time to time for availing of the Services and intimated to the CARDHOLDER through the Website or through any other medium, as the BOBCARDS may deem fit. BOBCARDS is authorised to debit such charges to the CARDHOLDER’s Accounts.
Without prejudice to the generality of the foregoing, BOBCARDS shall be entitled to debit service from the Account(s) of the CARDHOLDER if a Payment Instruction fails due to various reasons including, without limitation, (i) the CARDHOLDER not having sufficient unencumbered/ charged funds (or prearranged credit facilities) in its account for transactions comprised in any Payment Instruction; or (ii) the name of the CARDHOLDER and/or one or more details required for effecting the payment not having been correctly provided by the CARDHOLDER.
The grant of the Services to a CARDHOLDER is not transferable under any circumstance and shall be used only by the CARDHOLDER. The CARDHOLDER shall not assign its rights and/ or obligations under these Terms and Conditions or any part thereof to any other person. BOBCARDS may subcontract and employ agents to carry out any of its obligations under these Terms and Conditions.
BOBCARDS shall have the right of set-off and lien, irrespective of any other lien or charge, present as well as future, on the deposits held in the Account(s) or in any other account, whether in single name or joint name(s), in the Bank of Baroda to the extent of all outstanding dues, whatsoever, arising as a result of the Portal/ Website Services extended to and/ or used by the CARDHOLDER.
The construction, validity and performance of these Terms and Conditions shall be governed in all respects by the laws of India. The parties hereby submit to the non-exclusive jurisdiction of the Courts at Mumbai. The CARDHOLDER shall demonstrate his knowledge and acceptance of the aforesaid terms and conditions by logging onto or otherwise accessing or using the BOBCARDS’s Portal/ Website Services. If the CARDHOLDER does not agree with any of the terms or conditions as aforesaid, the CARDHOLDER should not use or attempt to use the BOBCARDS’s Portal/ Website Services in any manner whatsoever including by logging onto the “site”.
The CARDHOLDER acknowledges that the sending of information or instructions through telephone, mobile phone text messages, telex, facsimile, e-mail or other electronic means is not fully secure and may be intercepted by third parties. The CARDHOLDER authorizes the ISSUER to rely upon and act in accordance with any notice, information, instruction or other communication which may from time to time be, or purport to be, given by the CARDHOLDER or in the CARDHOLDER’s behalf via telephone, mobile phone text messages, telex, facsimile, e-mail, or other electronic means (the “Instructions”), which the ISSUER believes, in good faith, to have been made by the CARDHOLDER or upon his instructions or for his benefit. The ISSUER shall not be liable for any loss or damage that the CARDHOLDER may suffer as a result of the ISSUER’s reliance, action, or refusal to act upon the Instructions.
The ISSUER shall be entitled to treat the Instructions as fully authorized by and
binding upon the CARDHOLDER, and the ISSUER shall be entitled to take such steps
in connection with or on reliance upon the Instructions as the ISSUER may consider
appropriate, whether the Instructions include instructions to pay money or otherwise
to debit or credit any account, or relate to the disposition of any money, securities
or documents, or sending of information through mobile phone text messages, telex,
facsimile, e-mail, or other electronic means.
In order for the ISSUER to render prompt and accurate service, the CARDHOLDER authorizes
the ISSUER to record (without the ISSUER being necessarily obligated to do so) any
and all telephone conversations with the CARDHOLDER, whether initiated by the ISSUER
or by the CARDHOLDER, including without limitation, the CARDHOLDER’s instructions,
statements, complaints, inquiries and the ISSUER’s advice and reminders in relation
to the CARDHOLDER’s credit card account with the ISSUER. The ISSUER may use these
recordings for any purpose in any proceeding. The CARDHOLDER further agrees to waive
any right under The Anti-Wire Tapping Act (Republic Act No. 4200) or any amendments
thereto, or any similar law or regulation.
In consideration of the ISSUER acting on the Instructions, the CARDHOLDER hereby
irrevocably undertakes to indemnify the ISSUER and to keep the ISSUER indemnified
against all losses, claims, actions, proceedings, demands, damages, costs and expenses
that may be incurred or sustained by the ISSUER of whatever nature and howsoever
arising out of or in connection with the Instructions.T his authorization and indemnity
shall remain in full force and effect until the ISSUER receives from the CARDHOLDER
a written notice terminating the same save that such termination will not release
the CARDHOLDER from any liability under this authorization and indemnity in respect
of any act performed in accordance with its terms prior to such termination.
The CARDHOLDER hereby consents to the disclosure by the ISSUER of information about his/her account and credit standing to any of the ISSUER’S local or foreign branches, to any member of the BOBCARDS GROUP, to other credit card companies, to other financial institutions, to a court of competent jurisdiction or a government office or agency upon their order, to credit information/investigation companies, or to third party service providers assisting the ISSUER in the administration of its credit card business or providing insurance for the ISSUER against the CARDHOLDER’S default or providing insurance for the CARDHOLDER against fraud or unauthorized use of the CARD.
The CARDHOLDER agrees that the ISSUER reserves the right to investigate and confirm within a reasonable period in accordance with accepted and standard credit card business practice and procedure, as well as with existing laws and regulations any reported error or fraudulent transaction before making any corrections in the statement of account.
The CARDHOLDER shall notify the ISSUER in writing of any change in the CARDHOLDER’s civil status.
The CARDHOLDER shall comply with all laws and regulations related to the use of the CARD.
The enforceability and validity of this Agreement, in whole or in part, shall not be affected by the unenforceability or invalidity, whether temporary or permanent, of any particular provision of this Agreement because of restrictive laws, regulations, or judicial or administrative determinations obtained during any period of this Agreement or for any other cause.
No failure or delay on the part of the ISSUER in exercising any right or power hereunder shall operate as a waiver thereof nor shall any partial or single exercise of any such right or power preclude any other right or power thereunder. No waiver by the ISSUER of any of its rights or powers under this Agreement shall be deemed to have been made unless expressed in writing and signed by its duly authorized representative(s).
The ISSUER may, without prior notice, at any time and for whatever reason it may deem proper, amend, revise or modify the terms and conditions hereof, including the CARDHOLDER’S CREDIT LIMIT. The CARDHOLDER shall be deemed to have accepted the change if the CARDHOLDER continues to retain or use the CARD.
The CARDHOLDER undertakes to notify the ISSUER of any additional means of communicating
to the CARDHOLDER aside from what is disclosed in the credit card application, as
well as any change in the CARDHOLDER’s address, office or mailing address, e-mail,
and telephone number. In case the mailing address is not accessible through mail
or delivery, the ISSUER has the option to use the other addresses notified to ISSUER.
Notwithstanding this provision, the CARDHOLDER agrees that any communication sent
to the designated mailing address shall be considered as received by the CARDHOLDER
within eight (08) days after mailing.
Should the CARDHOLDER go out of the Republic of the Philippines for more than a
month, the CARDHOLDER undertakes to effect timely payment on the CARD. Otherwise,
the ISSUER reserves its right to restrain the CARD. If the CARDHOLDER leaves the
Republic of the Philippines to take up long term or permanent residence elsewhere,
all CARDS issued should be returned to the ISSUER fifteen (15) days prior to the
CARDHOLDER’s departure and the CARDS shall be deemed terminated and subject to the
immediate payment in full by the CARDHOLDER to the ISSUER of all outstanding balances,
obligations, and availments, posted or otherwise, under the CARDS.
The CARDHOLDER, pursuant to such undertaking, authorizes the ISSUER, at its discretion
but without any obligation to do so, to secure information from third parties, such
as but not limited to utility companies, insurers and financial intermediaries,
and receive information on how the CARDHOLDER can be contacted. Should the CARDHOLDER
be delinquent or be in default, the ISSUER reserves its right and the CARDHOLDER
authorizes the ISSUER, at the ISSUER’s sole discretion but without any obligation
to do so, to pursue all means of communicating with the CARDHOLDER, including without
limitation telephone messages, fax messages, mobile phone text messages, and other
third party inquiries, to establish contact with the CARDHOLDER.
Unless specifically otherwise instructed by the CARDHOLDER, the ISSUER may, from
time to time, inform the CARDHOLDER of its promotional offers through mail/e-mail/fax/SMS
or by telephone. Specially selected products and services of its branches, subsidiaries,
affiliates, agents and representatives or third parties selected by any of them
and certain companies may also be offered to the CARDHOLDER through mail/e-mail/fax/SMS
or by telephone.
The CARDHOLDER irrevocably agrees that any legal action, suit or proceeding arising out of or relating to these Terms and Conditions may be instituted, at the option of the ISSUER, in any competent court in Mumbai and CARDHOLDER submits to and accepts, with regard to any such action or proceeding for itself and in respect of its properties or assets, generally and unconditionally, the jurisdiction of any such court. The foregoing, however, shall not limit or be construed to limit the rights of the ISSUER to commence proceedings or to obtain execution of judgment against the CARDHOLDER in any venue or jurisdiction where assets of the CARDHOLDER may be found.
The CARDHOLDER’s activation or use of the CARD shall be deemed as his/her acceptance of and agreement to be bound by these terms and conditions and such amendments hereof as may be made by the ISSUER from time to time. These terms and conditions shall bind the CARDHOLDER and his/her heirs, executors and administrators, and successors and assigns.
The CARDHOLDER agrees not to use the CARD for the purchase of items/goods the importation into the Philippines of which is subject to the provisions of BSP Circular No. 1389, as amended, and all other circulars, laws, rules and regulations pertaining to importation. Likewise, the CARDHOLDER agrees and warrants that the proceeds of any cash advance availments abroad shall not be used for foreign investments or the payment of foreign loans or in violation of any existing foreign exchange rules and regulations.
The ISSUER has an agreement with VISA/MASTERCARD whereby the CARD shall be honored
at all VISA/MASTERCARD accredited merchants worldwide at all times. However, the
ISSUER shall not be liable to the CARDHOLDER if, for any reason, the CARD is not
honored by the merchant or the acquiring bank, or by VISA/MASTERCARD. The CARDHOLDER
agrees to hold the ISSUER free and harmless from any and all claims for damages
as a result of the failure of any accredited merchant or any acquiring bank, or
of VISA/MASTERCARD to honor the CARD. Further, the Bank shall not be responsible
for any defective product or service purchased through the CARD. Any complaint regarding
goods or services purchased using the CARD shall be referred to the merchant. This,
however, shall not affect the CARDHOLDER’S responsibility or obligation to pay the
outstanding balance on the CARD.
Upon restraint, suspension, cancellation, withdrawal or termination of the CARD,
the CARDHOLDER shall immediately cancel or terminate any subscription, enrolment,
payment authority and/or any recurring transaction arrangement he/she may have with
any accredited merchant. After the restraint, suspension, cancellation, withdrawal
or termination of the CARD, the CARDHOLDER shall be liable for any charges made
on the CARD in accordance with Clause 14 below.
